| 520 | _aThis paper examines the inadequacy of provisional relief provided by the Peruvian civil procedure framework for protecting plaintiffs seeking the recovery of property possession. It argues that the temporary measure on the merits in eviction matters has become obsolete in the context of contemporary real estate litigation. The study focuses its critique on the requirement of 'abandonment of the property' under Article 679 of the Civil Procedure Code to authorize the advance execution of the future final judgment—a condition deemed inherently contradictory: if the property is abandoned, the possessory dispute dissolves and the claim loses its practical utility. Drawing upon the Spanish model of provisional enforcement and the requirement of paying rent arrears under Article 449 of the Civil Procedure Act, as well as comparative Insights from Uruguay and Argentina, the author proposes a reformulation of provisional relief grounded on a prima facie case (fumus boni iuris) and the risk of delay (periculum in mora), while discarding unsuitable conditions. | ||
