520			_aEn una reciente sentencia de amparo del Tribunal Constitucional (Expediente N° 161-2022-PA/TC), se ha interpretado la Ley N° 30230 para establecer que no se puede aplicar la facultad del Estado de recuperar sus bienes si existe duplicidad de partidas, por lo que previamente se debe resolver en juicio quién tiene el derecho. El autor considera que esta es una sentencia equivocada, que condena al Estado a litigar por varios años antes de acceder a sus bienes, postergando el interés público frente a ciertos intereses particulares. Igualmente, afirma que, lamentablemente, dicha situación ha quedado convalidada por el Decreto Legislativo Nº 1726, del 11 febrero de 2026, norma que ha eliminado toda ventaja que tenía el Estado contra "ocupantes ilegales".

Consequently, the rightful ownership must be adjudicated in court prior to recovery. The author contends that this is an erroneous ruling that condemns the State ta years of litigation before regaining access to its assets, thereby subordinating the public interest to certain private interests. Furthermore, the author asserts that this situation has been unfortunately validated by Legislative Decree No. 1726, issued on February 11, 2026-a regulation that has eliminated the legal advantages the State previously held against "illegal occupants"
