Por: Valderrama Chevarría, José Guillermo [Autor]Tipo de material: TextoTextoIdioma: Español Descripción: páginas: 231-237Otro título: Does the notary exercise a special administrative function upon issuing a notarial certificate of domicile? Resumen: This article analyzes whether notaries exercise a special administrative function when issuing certificates of domicile. The author argues that, under the constitutional right to petition, the processing of these verifications is an exclusive duty of the notary to verify factual circumstances of habitation and possession. It notes that, although the Peruvian legal system establishes that the notary is not a public official, their activity is materially and formally framed within Administrative Law and Public Law, insofar as the State grants them the authority of public faith to authenticate individual legal situation's and prevent conflicts. Therefore, the issuance of the certificate of domicile constitutes a legitimate, reliable, and unalterable special administrative function that safeguards public order, good morals, and perfects the right to property formalization.
