This article analyzes the possibility of extending the fundamental right ta effective defense to Peruvian labor proceedings, based on its constitutional and conventional recognition as a manifestation of due process and the right of defense. The author argues that this guarantee should not be limited to criminal proceedings, but should also be projected onto the procedural model established by Law No. 29497, especially when the negligent conduct of counsel affects the legitimate interests of the parties. To this end, the article examines jurisprudential criteria, inter-American standards, and specific labor cases in which deficient legal defense generated a state of defenselessness. Finally, it proposes that labor judges may adopt remedial measures, such as the nullity of the procedural ac tor the replacement of counsel.
