This article argues that Popular Action Proceeding No. 30989-2023-Uma dees not, by itself, definitively establish the unconstitutionality of Articles 1, 2, 5, 8, and 9 of the Regulations to Law No. 29245, approved by Supreme Decree No. 001-2022-TR. From a constitutional perspective, it is argued that the prohibition on outsourcing core business activities is already encompassed in Articles 2 and 3 of Law No. 29245, as it forms part of the grounds for deeming the labor outsourcing regime to be distorted or misused. Aiong these lines, Constitutional Court Case No. 03097-2024-PA/TC appears to have recognized the constitutionality of such limitation. Therefore, this article proposes that labor judges may give precedence to this constitutional interpretation over the ruling issued by the Supreme Court in popular action proceedings ER -
