N2  - En el presente trabajo la autora analiza la naturaleza jurídica de la subsanación
de infracción es en el procedimiento de fiscalización laboral peruano, a partir
de su configuración normativa en la Ley General de Inspección del Trabajo y su reglamento.
Examina si la subsanación elimina el elemento de punición en la estructura de
la infracción administrativa y los requisitos para su procedencia, distinguiendo entre
infracciones subsanables e insubsanables y el momento oportuno para su realización.
Asimismo, desarrolla una posición crítica frente al modelo vigente que exonera de responsabilidad administrativa al empleador que subsana durante la etapa inspectiva,
cuestionando su impacto en la función disuasiva de la inspección laboral y en la tutela
efectiva de los derechos laborales
; In this paper, the author analyzes the legal nature of the correction of violations within
the Peruvian labor inspection procedure, based on its regulatory framework in the General Labor
inspection Law and its regulations. The study examines whether correction removes the element
of punishability in the structure of the administrative infringement and the requirements for
its application, distinguishing between remediable and irremediable violations, as well as the
appropriate timing for its execution. Furthermore, it develops a critical position regarding the current
model that exempts the employer from administrative liability when violations are corrected during
the inspection stage, questioning its impact on the deterrent function of labor inspection and on the
effective protection of labor rights
