N2  - El artículo analiza la aceptación de la indemnización por despido arbitrario
y sus efectos en la posibilidad de solicitar la reposición laboral, a partir de la Casación
Laboral Nº 11332-2022-Lima. Se examinan las diferencias entre el despido arbitrario
y el despido incausado en la legislación y jurisprudencia peruana, así como las consecuencias
jurídicas de optar por la tutela indemnizatoria o restitutoria. Asimismo, se
estudia el caso de una trabajadora que devolvió la indemnización depositada por su
empleador dentro del plazo legal para impugnar el despido. El análisis concluye que la
devolución oportuna del monto permite cuestionar el despido y solicitar la reposición
; This article analyzes the acceptance of compensation for arbitrary dismissal and its effects on
the possibility of requesting reinstatement, based on Labor Cassation No. 11332-2022-Limo. lt examines
the differences between arbitrary dismissal and dismissal without cause in Peruvian legislation and
jurisprudence, as well as the legal consequences of opting for compensatory or restorative protection.
Additionally, the article studies the case of o worker who returned the compensation deposited by her
employer within the legal time limit to challenge the dismissal. The analysis concludes that the timely
return of the amount allows the worker to contest the dismissal and seek reinstatement
