N2  - En el presente trabajo la autora analiza la relación entre el retiro de confianza
y la protección reforzada de la trabajadora gestante a partir de la sentencia del
Tribunal Constitucional recaída en el Expediente Nº 00297-2020-PA/TC. El estudio examina
los límites del retiro de confianza cuando su aplicación puede encubrir actos de
discriminación por razón de embarazo. Asimismo, se revisa el marco normativo y jurisprudencial
relativo al despido nulo por gestación y la carga probatoria del empleador
para acreditar una causa objetiva distinta al estado de gravidez. Se concluye que la protección
constitucional de la maternidad prevalece incluso frente a cargos de confianza
cuando el cese carece de justificación objetiva
; In this paper, the author analyzes the relationship between the withdrawal of trust and
the reinforced protection afforded to pregnant workers, based on the judgment issued by the
Constitutional Court in Case No. 00297-2020-PA/TC. The study examines the limits of the withdrawal
of trust when its application may canceal acts of discrimination on the grounds of pregnancy. lt also
reviews the regulatory and jurisprudential framework concerning null dismissal due to pregnancy and
the employer's burden of proof to demonstrate an objective cause unrelated to the worker's condition
of pregnancy. lt is cancluded that the constitutional protection of maternity prevails even in positions
of trust when the termination locks objective justification
