N2  - El presente artículo analiza el régimen jurídico de la Compensación por
Tiempo de Servicios (CTS) en el ordenamiento laboral peruano, destacando su naturaleza
previsional y su función de protección frente al desempleo. Se examina el marco
normativo aplicable, los requisitos para acceder al beneficio, las reglas sobre su depósito,
cálculo y remuneración computable, así como las particularidades de diversos
regímenes laborales especiales. Asimismo, se abordan los supuestos de pago directo, la
libre disponibilidad de los fondos y las recientes modificaciones normativas que permiten
el retiro del 100 % de la CTS. Finalmente, se analizan las consecuencias del incumplimiento del empleador y las infracciones administrativas correspondientes.
; This article analyzes the legal regime of the Compensation far Length of Service (CTS) within
the Peruvian labor legal system, highlighting its social security nature and its function as protection
against unemployment. lt examines the applicable regulatory framework, the requirements to access
this benefit, the rules governing its deposit, calculation, and computable remuneration, as well as the
particularities of various special labor regimes. lt also addresses the cases of direct payment, the free
availability of the funds, and recent regulatory amendments that allow the withdrawal of 100% of the
CTS. Finally, the article analyzes the consequences of employer non-compliance and the corresponding
administrative infractions
