  <abstract>El artículo propone una lectura crítica del despido del personal de dirección
cuando se fundamenta en conductas desarrolladas fuera del ámbito estrictamente laboral.
Se sostiene que el poder disciplinario del empleador no puede operar de forma
automática ni expansiva frente a actos privados, incluso tratándose de altos directivos.
La falta grave exige una afectación real y jurídicamente relevante de la buena fe laboral,
evaluada con criterios de proporcionalidad y razonabilidad. El despido aparece, así,
como un mecanismo excepcional, condicionado a la protección legítima de la empresa
sin vaciar el contenido garantista del Derecho del Trabajo.

  <abstract> This article offers a critical analysis of the dismissal of managerial personnel when it is
based on conduct occurring outside the strict scope of the employment relationship. lt argues that
the employer's disciplinary power cannot operate automatically or expansively with respect to private
conduct, even in the case of senior executives. Serious misconduct requires a real and legally relevant
impairment of the duty of good faith in employment, assessed in accordance with the principles of
proportionality and reasonableness. Dismissal thus emerges as on exceptional measure, conditioned
upon the legitimate protection of the enterprise without undermining the protective foundations of
labor law.
