  <abstract>El autor sostiene que, a partir de la sentencia recaída en el Expediente N° 1905-2024-PA/TC, el Tribunal Constitucional ha reafirmado la validez del cese por jubilación
obligatoria mediante la aplicación inmediata del artículo 21 del Texto Único Ordenado
del Decreto Legislativo N° 728, incluso frente a acuerdos de continuidad laboral. No
obstante, advierte que dicha interpretación resulta incompatible con las obligaciones
internacionales asumidas por el Estado peruano al ratificar la Convención lnteramericana
sobre la Protección de los Derechos Humanos de las Personas Mayores, que exige
igualdad y protección frente al despido por edad. En ese sentido, decisiones del Tribunal
Constitucional y de la Corte Suprema evidencian un incumplimiento internacional
al validar una extinción laboral basada exclusivamente en la edad, configurando un
trato discriminatorio y generando responsabilidad estatal.

  <abstract>The author argues that, fallowing the Judgment issued in Case No. 1905-2024-PA/TC, the
Constitutional Court has reaffirmed the validity of termination due to mandatory retirement through the
immediate application of Article 21 of the Consolidated Text of Legislative Decree No. 728, even in the
presence of employment continuity agreements. However, the author warns that such interpretation is
incompatible with the international obligations assumed by the Peruvian State upon ratifying the InterAmerican
Convention on the Protection of the Human Rights of 0/der Persons, which requires equality
and protection against dismissal based on age. In this regard, decisions of the Constitutional Court and
the Supreme Court reveal an international breach by validating termination based exclusive/y on age,
thereby constituting discriminatory treatment and generating State responsibility.
