obstante, advierte que dicha interpretaci&#xF3;n resulta incompatible con las obligaciones
internacionales asumidas por el Estado peruano al ratificar la Convenci&#xF3;n lnteramericana
sobre la Protecci&#xF3;n de los Derechos Humanos de las Personas Mayores, que exige
igualdad y protecci&#xF3;n frente al despido por edad. En ese sentido, decisiones del Tribunal
Constitucional y de la Corte Suprema evidencian un incumplimiento internacional
al validar una extinci&#xF3;n laboral basada exclusivamente en la edad, configurando un
trato discriminatorio y generando responsabilidad estatal.

presence of employment continuity agreements. However, the author warns that such interpretation is
incompatible with the international obligations assumed by the Peruvian State upon ratifying the InterAmerican
Convention on the Protection of the Human Rights of 0/der Persons, which requires equality
and protection against dismissal based on age. In this regard, decisions of the Constitutional Court and
the Supreme Court reveal an international breach by validating termination based exclusive/y on age,
thereby constituting discriminatory treatment and generating State responsibility.
