N2  - En el presente artículo la autora desarrolla el análisis de la validez de
los acuerdos de descanso vacacional celebrados a través de medios tecnológicos,
a la luz de la normativa laboral vigente y de los criterios del Tribunal de Fiscalización
Laboral. Se examinan las distintas modalidades de acuerdos vacacionales y
la exigencia del consentimiento entre trabajador y empleador, destacándose que
dicho acuerdo puede acreditarse válidamente a través de plataformas digitales.
A partir del estudio de un caso relevante, se concluye que la desmaterialización
de los acuerdos vacacionales es compatible con el ordenamiento laboral peruano,
siempre que se garantice la libre manifestación de la voluntad del trabajador y la
protección de sus derechos fundamentales
; In this article, the author analyzes the validity of vacation leave agreements concluded
through technological means, in light of the current labour legislation and the criteria established
by the Labour lnspection Tribunal (Tribunal de Fiscalización Laboral). The study examines the
different types of vacation agreements and the requirement of consent between the worker and
the employer, emphasizing that such consent may be validly evidenced through digital platforms.
Based on the analysis of a relevant case, the article concludes that the dematerialization of
vacation agreements is compatible with the Peruvian labour legal system, provided that the
worker's free manifestation of will and the protection of fundamental rights are guaranteed
