páginas 110-131 La pérdida de oportunidad constituye una de las figuras más controvertidas y relevantes del moderno derecho de daños. En el ámbito de la responsabilidad civil profesional del abogado, esta categoría adquiere especial trascendencia cuando la actuación negligente del letrado frustra la posibilidad del cliente de obtener una resolución judicial favorable. El presente artículo analiza la pérdida de oportunidad procesal desde una perspectiva dogmática y jurisprudencial, con especial énfasis en su configuración como daño autónomo y patrimonial, su diferenciación frente a otros tipos de daños tradicionalmente reconocidos y los métodos de cuantificación empleados. El estudio adopta un enfoque comparado entre los ordenamientos jurídicos de España y Perú, evidenciando el mayor desarrollo jurisprudencial español y la todavía incipiente construcción doctrinal peruana. Finalmente, se formulan propuestas interpretativas orientadas a una correcta recepción de la figura en el Derecho peruano. This article examines procedural loss of chance from o doctrinal and jurisprudential perspective, focusing on its recognition as an autonomous and patrimonial damage, its distinction from traditional categories of damage, and the methods used for its quantification. A comparative analysis between Spanish and Peruvian legal systems highlights the advanced development of Spanish case low and the still incipient Peruvian approach. The article concludes with interpretative proposals aimed at facilitating the proper incorporation of this doctrine into Peruvian civil liability law.
