Para ello desarrolla al "principio protector" y lo distribuye en cuatro "sub-principios": a) principio del interés superior del niño; b) principio de solidaridad familiar; c) principio protector del adulto mayor; y, d) principio protector de la persona con discapacidad. Más allá del reconocimiento constitucional de dicho principio, el autor demuestra que este se materializa en la práctica judicial a través de la intervención activa del defensor, quien articula la tutela de los derechos fundamentales de los sujetos de especial protección. Este análisis se sustenta en la experiencia práctica del autor y casos de éxito que fueron patrocinados en la Defensa Pública, a fin de evidenciar que la actuación del Defensor Público de Familia garantiza el acceso a la justicia de los sujetos más vulnerables. The author posits that the Public Family Defender acts as an intermediary far the effective application of the protective principle for minors and vulnerable persons within the Family sphere. To this end, develops the concept of the "protective principle" categorizing it into four "sub -principles": a) the principle of the best interests of the child; b} the principle of family solidarity; c) the protective principle for the elderly; and d) the protective principle far persons with disabilities. Beyond the constitutional recognition of this principle, the author demonstrates that it materializes in judicial practice through the active intervention of the defender, who articulates the protection of the fundamental rights of subjects requiring special protection. This analysis is supported by the author’s practical experience and success cases sponsored by the Public Defense Service, aiming to evidence that the actions of the Public Family Defender guarantee access to justice far the most vulnerable individuals.
