    <subfield code="a">En una reciente sentencia (Expediente N&#xB0; 00161-2022 - PA/TC), el Tribunal Constitucional precis&#xF3; el alcance de la recuperaci&#xF3;n extrajudicial de predios de propiedad estatal, prevista en la Ley N&#xB0; 30230. El autor manifiesta su conformidad con dicha decisi&#xF3;n y afirma que el Colegiado no niega la validez constitucional de este mecanismo, sino que delimita con claridad su &#xE1;mbito leg&#xED;timo de aplicaci&#xF3;n. As&#xED;, refiere que la sentencia establece que dicha potestad es una t&#xE9;cnica excepciona l de defensa frente a invasiones u ocupaciones manifiestamente ilegales, y no un mecanismo para resolver controversias de titularidades de naturaleza compleja. En ese sentido, cuan do el particular exhibe un t&#xED;tulo inscrito en Registros P&#xFA;blicos, la controversia deja de ser estrictamente posesoria y se convierte en un conflicto sobre titularidad que exige contradicci&#xF3;n probatoria.</subfield>

    <subfield code="a">In o recent ruling (Cose No. 00161-2022-PA/TC), the Constitutional Court specified the scope of extrajudicial recovery of state-owned real estate, as provided for under Law No. 30230. The author expresses concurrence with said decision, asserting thot the Court does not deny the constitutional validity of this mechanism, but rother clearly defines its legitimate scope of application. Thus, the author notes that the judgment establishes this authority as an extraordinary defense technique against manifestly illegal invasions or squatting, rother than o mechanism to resolve complex title disputes. Consequently, when a private party presents a title deed registered in the Public Registry, the controversy ceases to be strictly possessory and evolves into a conflict over ownership that requires an evidentiary hearing.</subfield>
