páginas 219-228 Actualmente, cuando una persona adulto mayor se apersona a una notaría, en muchas ocasiones no pude concluir, ni iniciar el acto y/o contrato que contiene la transmisión de sus derechos patrimoniales, por requerírsele la obtención y tramitación del certificado médico de salud mental. El autor se pregunta si es válida esta exigencia. Así, refiere que, al momento de solicitar el certificado médico, el notario no restringe el derecho de libre contratación, sino que más bien resguarda dicha voluntad, con un recaudo técnico que acredita que la persona solicitante ejerce su manifestación de voluntad plena y sin restricciones en resguardo de la fe pública. Por ello, considera que es válida la exigencia del mencionado certificado médico.
