On April 22, 2026, the U.S. acting attorney general issued a final rule immediately reclassifying state-licensed medical marijuana products and future Food and Drug Administration (FDA)–approved marijuana products under Schedule III of the Controlled Substances Act. Medical marijuana (cannabis containing ≥0.3% tetrahydrocannabinol), now legal in 40 states, three territories, and the District of Columbia, was previously federally designated as a Schedule I drug — the category of drugs that are the most tightly controlled.
