La transacción extrajudicial en materia laboral ¿Renuncia encubierta o ejercicio legítimo de disponibilidad de derechos? - páginas 119-126
En el presente trabajo los autores analizan la relación entre el principio
constitucional de irrenunciabilidad de derechos laborales y la validez de la transacción
extrajudicial, a propósito de la Casación Laboral Nº 15429-2022-lca. El estudio
examina la naturaleza jurídica de la transacción como contrato oneroso sustentado
en concesiones recíprocas sobre derechos litigiosos o dudosos, diferenciándola de la
renuncia unilateral y gratuita proscrita por el ordenamiento laboral. Asimismo, se aborda
la distinción entre irrenunciabilidad e indisponibilidad de derechos y se evalúa la
compatibilidad del acuerdo con el test de disponibilidad previsto en el artículo 30 de la
Nueva Ley Procesal del Trabajo. Se concluye que la transacción analizada no vulnera el
principio de irrenunciabilidad, al no implicar abdicación unilateral de un derecho cierto
e imperativo.
In the present work, the authors analyze the relationship between the constitutional principle
of the non-waivability af labor rights and the validity of extrajudicial settlements, in light of Labor
Cassation No. 15429-2022-lca. The study examines the legal nature of settlement as an onerous
contract based on reciprocal concessions concerning disputed or uncertain rights, distinguishing it
from the unilateral and gratuitous waiver prohibited by the labor legal system. lt also addresses the
distinction between nan-waivability and the unavailability of rights, and evaluates the compatibility
of the agreement with the availability test established in Article 30 of the New Labor Procedural Law.
lt is concluded that the settlement analyzed does not violate the principle of non-waivability, as it does
not entail the unilateral abdication of a certain and mandatory right.
