Mediante el reciente Decreto Legislativo N° 1703 se ha creado la Superintendencia de Defensa Pública y Acceso a la Justicia (Sunadep), entidad que ahora tendrá la conducción de la conciliación extrajudicial, función que durante más de dos décadas
desempeñó el Ministerio de Justicia a través de un órgano técnico especializado como
lo es la Dirección de Conciliación Extrajudicial y Mecanismos Alternativos de Solución
de Conflictos. Sobre el particular, el autor expresa su preocupación de que esta reorganización genere pérdida de especialización, retraso en acreditaciones de conciliadores o debilitamiento del sistema sancionador a los malos operadores de la conciliación, lo cual podría conllevar a una regresión nefasta del sistema conciliatorio en su conjunto, pues advierte que la Sunadep es, en esencia, un organismo ejecutor, no un ente especializado en regulación de medios alternativos de resolución de conflictos.
Through the recent Legislative Decree No. 1703, the Superintendency of Public Defense
and Access to Justice (SUNADEP) has been established. This entity shall now oversee out-of-court conciliation, a function performed for over two decades by the Ministry of Justice through a specialized technical body: the Directorate of Out-of-Court Conciliation and Afternote Dispute Resolution Mechanisms. Regarding this matter, the author expresses concern that such reorganization may result in o loss of expertise, delays in the accreditation of conciliators, or the weakening of the disciplinary framework applicable to misconduct by practitioners. This could lead to a detrimental regression of the conciliation system as a whole, as the author notes that SUNADEP is essentially on executive agency rother thon a specialized body far the regulation of Alternative Dispute Resolution (ADR).
